Why would Yotpo's emails be classified as marketing? They are not selling the customer anything, but asking for the customer's opinion on something they've already bought. It's more like surveying than marketing. It's only sent once (unlike most survey companies who insist with multiple emails that you take their survey).
I am not sure how the anti-spam email laws define "marketing," but yotpo's mail after purchase doesn't sound like marketing to me.
